Terms of Use

Please read these Terms before using PushEvery AI. They govern AI content generation, content editing, connected-platform authorization and publishing, memberships, and Credits. You remain responsible for the content you submit and choose to publish.

1. Agreement and service provider

These Terms of Use (“Terms”) are an agreement between you and the developer and seller identified on the PushEvery AI App Store product page (“PushEvery AI,” “we,” “us,” or “our”). They apply to the PushEvery AI app, cloud functions, generated content features, publishing tools, and related support (the “Service”).

By downloading, accessing, purchasing through, or using the Service, you agree to these Terms, the Privacy Policy, and, if applicable, the Subscription Terms. If you do not agree, do not use the Service.

2. Apple licence terms

The licence to the iOS application is also governed by Apple’s Standard End User License Agreement (“Apple Standard EULA”), which is incorporated into these Terms. These Terms govern the Service features we provide and supplement the Apple Standard EULA. If there is an irreconcilable conflict about the app licence, the Apple Standard EULA controls to the extent required by Apple.

3. Eligibility

You must be at least 13 years old and at least the minimum age required to consent to digital services in your jurisdiction. If you are not legally able to enter a binding agreement, a parent or legal guardian must review and accept these Terms for you. The Service is not intended for a person barred from using it under applicable law.

4. The Service and device account

PushEvery AI can turn prompts and user-selected media into copy, images, or videos; adapt content for selected platforms; store work and publishing status; connect eligible third-party accounts; and publish content after your review or confirmation.

The current Service creates a device-level account using a device or installation identifier. You are responsible for keeping your device secure. Uninstalling the app, resetting the device, or changing devices may affect access to cached content, connected-platform authorizations, history, and consumable Credits. Eligible Apple subscriptions can be restored using the in-app Restore Purchases feature, subject to Apple’s records and the Subscription Terms.

5. Limited licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Service on Apple-branded devices you own or control, as permitted by the Apple Standard EULA and App Store rules, for lawful personal or internal business purposes.

You may not copy, rent, lease, sell, redistribute, reverse engineer, bypass security or billing controls, probe non-public interfaces, extract models or datasets, automate abusive requests, or create a competing service from protected parts of the Service, except where a restriction is prohibited by law.

6. Your content and permissions

“User Content” means prompts, instructions, text, images, video, audio, logos, links, account selections, and other material you submit or direct the Service to process. As between you and us, you retain your rights in User Content.

You grant us and our service providers a worldwide, limited, non-exclusive right to host, copy, format, transmit, modify, generate from, and publish User Content only as reasonably necessary to provide, secure, support, and improve the requested Service functionality. This permission ends when the relevant data is deleted, except for published copies, protected backups, legal retention, and rights already granted to a destination platform.

You represent that you have all rights, permissions, licences, and lawful bases needed for User Content and its intended use. You must not upload or publish content that infringes intellectual property, privacy, publicity, confidentiality, consumer-protection, advertising, or other rights.

8. Connected platforms and publishing

Connecting an account authorizes the Service and its publishing provider to access limited account information and submit content within the permissions you approve. You remain responsible for the connected account, its administrator permissions, audience and privacy settings, and every final publishing instruction.

Publishing can be irreversible and may send content to followers or the public. Review the destination, account, audience, title, body, media, links, and required disclosures before confirmation. A destination platform may reject, delay, alter, remove, restrict, or retain content under its own terms. PushEvery AI is not affiliated with or endorsed by those platforms unless expressly stated.

You must not use the Service to create, upload, authorize, or publish:

You may not use automated means to overload the Service or publish substantially duplicative content in violation of platform rules.

10. Memberships, Credits, and purchases

Auto-renewable memberships and consumable Credits are sold through Apple In-App Purchase. Subscription length, localized price, included Credits, renewal, cancellation, expiration, plan changes, refunds, and restoration are described on the purchase screen and in the Subscription Terms.

Credits are limited, revocable digital service units with no cash value. They are not transferable or redeemable outside the Service. The app shows or obtains a Credits quote before a billable task. We may correct duplicate grants, reverse Credits associated with a refund or revoked transaction, and restrict billable actions when a refunded balance has already been consumed.

11. Third-party services

The Service relies on Apple, cloud infrastructure, AI-generation providers, an authorization and publishing provider, and platforms you choose to connect. Your use of each third-party service is also subject to its terms and privacy policy. We are not responsible for third-party acts, content, policies, account restrictions, API availability, outages, or changes outside our reasonable control.

12. Our intellectual property

The Service, including its software, interface, branding, graphics, workflows, pricing logic, documentation, and non-user content, is owned by us or our licensors and protected by law. Except for the limited licence in Section 5, no right is granted to our trademarks, software, or other intellectual property. Feedback you voluntarily provide may be used without restriction or compensation, provided we do not publicly identify you without permission.

13. Suspension and termination

You may stop using the Service at any time; cancelling a subscription requires the separate Apple cancellation process. We may suspend or limit access when reasonably necessary to address a Terms violation, unlawful or harmful activity, fraud, security risk, unpaid or refunded entitlement, technical emergency, third-party platform restriction, or legal requirement. Where reasonable, we will provide notice or an opportunity to appeal through App Support.

Sections that by their nature should survive termination—including ownership, payment and refund adjustments, disclaimers, liability limits, dispute terms, and lawful retention—will survive.

14. Service changes and availability

We may add, change, suspend, or discontinue features, models, platforms, formats, or usage limits. We do not promise uninterrupted or error-free operation, successful generation, or successful publishing. We will provide the service and benefits purchased for a paid period as required by applicable law and Apple’s rules, subject to outages and circumstances outside reasonable control.

15. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes a warranty, guarantee, or consumer right that cannot lawfully be excluded.

16. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, opportunity, audience, data, reputation, or business; or consequences of content you approve for publishing, third-party platform action, or unauthorized use of your device or connected account.

Where liability may lawfully be limited, our total liability arising from the Service will not exceed the greater of the amount you paid for the Service during the six months before the event giving rise to the claim or USD 50. This limit does not apply to liability that applicable law prohibits us from limiting, including where applicable fraud, wilful misconduct, death, or personal injury caused by negligence.

17. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless PushEvery AI and its service providers from third-party claims, losses, and reasonable costs arising from your User Content, your publishing instructions, your violation of these Terms, or your infringement of another person’s rights. This section does not require a consumer to indemnify us for our own unlawful conduct.

18. Governing terms and disputes

The governing-law and venue provisions in the Apple Standard EULA apply to the app licence. For the Service, mandatory consumer protections and courts available in your country of residence remain unaffected. Before filing a claim, please use App Support and give us a reasonable opportunity to resolve the issue, unless applicable law allows you to proceed immediately.

19. Changes to these Terms

We may update these Terms for changes to the Service, law, security, providers, or App Store requirements. We will update the date above and provide additional notice when required. A material change will apply prospectively. If you do not agree to revised Terms, stop using the Service and cancel any auto-renewal.

20. Apple-related acknowledgements

You acknowledge that these Service Terms are between you and us, not Apple. We, not Apple, are responsible for the Service, support, warranties not disclaimed, and claims concerning the Service, subject to the Apple Standard EULA. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions. You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on a U.S. Government prohibited or restricted-party list.
